מחר נקרא בפרשת "שופטים ושוטרים תתן לך בכל שעריך אשר ה' אלוהיך נותן לך לשבטיך".

על אכיפה, משפט וענישה.
בפרשה מפורטים חוקי השופטים והמלך, 'איזונים ובלמים':
"לא תטה משפט, לא תכיר פנים, לא תיקח שוחד.. לא ירבה סוסים, נשים וכסף.."
אך למנהל הכלא מותר להשתולל:

חלוקת התפקידים במשפט הם:
* העדים- לוקחים אחריות על טובת הכלל ומקיימים "ובערת הרע מקרבך".
כמה עדים? "על פי שניים או שלושה עדים. לא עד אחד"
* השופט- "והוגד לך ושמעת ודרשת היטב והנה אמת נכון הדבר נעשתה התועבה הזאת בישראל".
רק לאחר חקירה מעמיקה פוסקים את הדין.
* ומי המעניש? "יד העדים תהיה בו בראשונה".
העם לוקח אחריות ומעיד, השופט שופט, והעם לוקח אחריות גם על הביצוע.

האם כל פרחח יכול להעיד ולבצע? חס וחלילה!
"וכי יקום עד חמס באיש לענות בו סרה.. ודרשו השופטים והנה עד שקר.. ועשיתם לו כאשר זמם לעשות, ולא תחוס עיניך!"

חוקי התורה נכתבו לפני אלפי שנים, העולם התקדם והשתנה, איך נדע האם החוק רלוונטי?
הפרשה עונה:
"כי יפלא ממך דבר למשפט, בין דם לדם בין דין לדין, וקמת ועלית אל המקום אשר יבחר ה' אלוהיך בו. ועשית על פי הדבר אשר יגידו לך מן המקום ההוא אשר יבחר ה' ושמרת לעשות ככל אשר יורוך".

התיק הקשוח ביותר הוא כשאדם נהרג.
אם התגלה בשדה- יש טקס מיוחד בנחל הקרוב.
אם נהרג בשוגג- ההורג ינוס אל אחת מערי המקלט, וחי.
אך אם "יהיה איש שונא, וארב וקם הכהו נפש ומת, ונס אל הערים… וזקני עירו לקחו אותו משם ונתנו ביד גואל הדם- ומת"
אין עונש מאסר בכלא

השבוע התקיים דיון סוער אליו הצטרף השגריר המקביל בישראל.
על מצור שעשו יהודים, שהוביל לכך שחיילי צה"ל נשלחו להיות שופטים ושוטרים.
נושא הסערה: "לא תשיג גבול רעך אשר גבלו ראשונים". לפסוק הזה יש המשך "בנחלתך אשר תנחל בארץ אשר ה' אלוהיך נותן לך לרישתה".
האם זה צודק? הרי כתוב "צדק צדק תרדוף"! וגם לפסוק הזה יש המשך "למען תחיה וירשת את הארץ אשר ה' אלוהיך נותן לך"
כשמצטטים את הפסוקים בשלמותם, רואים את הדיון בזווית קצת שונה.

מה ציטוט יעזור כשכל העולם צופה בזה?
על זה ההפטרה עונה וגם מתארת את המסיבה שבשיר:
"קול צופייך נשאו קול יחדיו ירננו, כי עין בעין יראו בשוב ה' ציון. פצחו רננו יחדיו חרבות ירושלים, כי ניחם ה' עמו גאל ירושלים"

היום מתחיל חודש הרחמים והסליחות. שנזכה לראות עין בעין, ונבדיל בין אויב לאוהב, בין חייל לשוטר, בין שופט לעד, בין ענישה למסיבה.
ויהיה לכולנו יום שבת "משמיע שלום מבשר טוב משמיע ישועה אומר לציון: מלך אלוהייך" (או אלביס)

Tomorrow we will read Shoftim "Judges and Policeman you shall give to you in all your gates which God gives you to your tribes".

About enforcement, justice and punishment.

The parsha details the laws for the judges and the king:
"shall not pervert justice, nor know faces, shall not take bribes.. shall not multiply horses, women and money.."
But the prison warden is allowed to go wild:

The division of roles in the trial are:
* The witnesses – take responsibility for the common good and fulfill "put away evil from among you".
How many witnesses? "According to two or three witnesses. Not one witness"
* The judge- "And it was told you, and you heard and inquired carefully, and behold it is true , this abomination has been done in Israel".
Only after a thorough investigation the judgment is declared.
* And who is the punisher? "The hand of the witnesses shall be upon him first."
The people take responsibility and testify, the judge judges, and the people also take responsibility for the execution.

Can every brat testify and execute? God forbid!
"And if a Hamas witness is raised against a man falsely… and the judges inquired and behold, the witness is false… and you did to him as he intended to do, and your eyes did not spare!"

The laws of the Torah were written thousands of years ago, the world has progressed and changed, how do we know if the law is relevant?
The parasha answers:
"If a matter is too great for you to judge, between blood for blood, between case for case, then you arise and go up to the place which the Lord your God will choose. And you shall do according to the word that they shall tell you from that place which the Lord shall choose and be careful to do according to all that he shall command you"

The toughest case is when a person is killed.
If he was found in the field – there is a special ceremony in the nearby stream.
If he was killed accidentally – the slayer shall flee to one of the cities of refuge, and live.
But if "there is a man of hatred, and he lies in wait and rises up and strikes him, and he dies, and flees to the cities… and the elders of his city take him from there and give him into the hand of the blood-redeemer – and he dies."

This week there was a heated debate, which the ambassador in Israel have joined.
About a siege made by Jews, which led to IDF soldiers being sent to be judges and policemen.
The topic of the storm: "You shall not reach your neighbor's border, which they first marked." This verse has a continuation "In your inheritance which you shall inherit in the land which the Lord your God gives you to inherit it".
Is this right? After all, it is written "Justice Justice you shall pursue"! And this verse also has a continuation "That you may live and inherit the land which the Lord your God gives you"
When the verses are quoted in their entirety, we see the discussion from a slightly different angle.

What is a quotation to help when the whole world is watching this?

The Haftarah answers this and also describes the party in the song:
"The voice of your watchmen lifted up the voice together, they shouted, for eye to eye they shall see the Lord's return to Zion. They broke open the walls of Jerusalem together, they shouted, for the Lord has comforted his people, the Redeemer of Jerusalem."

Today begins the month of mercy and forgiveness. May we be worthy to see eye to eye, and distinguish between enemy and lover, between soldier and policeman, between judge and witness, between punishment and party.
And we will all have a Sabbath, " who proclaims peace, who brings good news, who proclaims salvation, who says to Zion: the KING is God" (or Elvis)
